sc-same-sex-couples-co-own-property-family-code-phMANILA, Philippines — In a landmark decision hailed as a major stride toward equality, the Supreme Court has ruled that same-sex couples living together in the Philippines may legally co-own properties, provided there is clear proof of financial contribution.

The High Court clarified that same-sex partners fall under Article 148 of the Family Code, which governs property relations of couples who are not legally allowed to marry. This ruling firmly establishes that love, partnership, and shared effort—regardless of sexual orientation—deserve legal recognition and protection.

In its decision, the Supreme Court reversed earlier rulings of the Court of Appeals and a regional trial court, recognizing a petitioner as a co-owner of a house and lot in Quezon City that she shared with her former same-sex partner. The Court acknowledged that both parties contributed equally to the purchase and renovation of the property, even though the title was registered under only one name.

Senior Associate Justice Marvic Leonen, in a concurring opinion, stressed that same-sex relationships are normal and legitimate, warning that excluding them from legal protection would render many intimate relationships “legally invisible.”

“This ruling uses the law to protect people who are often left at its fringes,” Leonen said, underscoring the importance of making freedoms socially and individually meaningful.

While the Court noted that broader rights for same-sex couples require legislative action from Congress, the decision is being widely celebrated as a historic victory for LGBTQ+ rights and a powerful affirmation of inclusion, fairness, and shared humanity.

The ruling, penned by Associate Justice Jhosep Lopez, was promulgated in February 2025 and made public in February 2026.
